Acceptance of terms

By accessing or using GulshanSync (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms form a legally binding agreement between you (and the organization you represent) and GulshanSync ("we", "us", "our").

Description of service

GulshanSync is a unified platform for political campaign management, field operations, and public engagement. The Service includes three integrated products — GulshanSync ERP, SureWin, and GulshanSync Connect — accessible via web browsers at gulshansync.com and its subdomains.

Eligibility

You must be at least 18 years old and have the legal authority to bind your organization to these Terms. By using the Service, you represent and warrant that you meet these requirements.

Accounts

To use the Service, your organization's administrator must create an account for you. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify your administrator immediately if you suspect any unauthorized use of your account.

Organizations are responsible for managing user accounts within their tenant, including role assignments, permission grants, and account deactivation when users leave the organization.

Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law.
  • Upload, post, or transmit content that is illegal, harmful, defamatory, hateful, or otherwise objectionable.
  • Attempt to gain unauthorized access to another tenant's data or to the Service's systems.
  • Interfere with or disrupt the Service, including introducing viruses or attempting to overload the system.
  • Use the Service to harass, threaten, or harm any person.
  • Resell or sublicense access to the Service without our written consent.
  • Reverse engineer, decompile, or otherwise attempt to extract source code from the Service.

Content

You retain ownership of all content you upload to or create within the Service. You grant us a limited license to host, process, and display your content as necessary to operate the Service for your organization.

You are responsible for ensuring you have the rights to upload content to the Service and that your content complies with applicable laws and these Terms.

Multi-tenant isolation

The Service is a multi-tenant platform. Multiple organizations share the same installation, but data is strictly isolated between tenants. We enforce this isolation at the database layer. We do not access tenant data without explicit authorization, except for system maintenance, security investigations, or as required by law.

Service availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may experience downtime for maintenance, upgrades, or due to circumstances beyond our control. We are not liable for any loss resulting from Service unavailability.

Fees and billing

Pricing plans are being finalized and will be published when available. Organizations using the Service under a paid plan are responsible for all fees associated with their plan. Fees are due as specified in your organization's subscription agreement.

Termination

You may stop using the Service at any time. Your organization's administrator may deactivate your account at any time. We may suspend or terminate access to the Service for violations of these Terms or for any other reason we deem appropriate, with or without notice.

Upon termination, your organization's data will be retained for a period defined in your subscription agreement, after which it may be permanently deleted.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be error-free, secure, or available at all times.

Limitation of liability

To the fullest extent permitted by law, GulshanSync shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service.

Indemnification

You agree to indemnify and hold GulshanSync harmless from any claims, damages, losses, and expenses (including legal fees) arising from your use of the Service or your violation of these Terms.

Governing law

These Terms shall be governed by and construed in accordance with the laws of Bangladesh, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Bangladesh.

Changes to these terms

We may modify these Terms from time to time. We will notify users of significant changes by posting a notice on the platform or sending an email. Continued use after changes take effect constitutes acceptance of the updated Terms.
